PRIVACY POLICY

1.    Scope of Privacy Policy

This document (“Privacy Policy”) describes the measures we take to help preserve the privacy of personally identifiable information of visitors and account holders accessing http://www.CloudMediaWorks.com and other sites owned and operated by Cloud Media Works LLC, (collectively, “Website” or “Site”), and the personally identifiable information of account holders using the Cloud Media Works LLC, software as service (“Cloud Media Works Service”). This Privacy Policy is intended to help our Website visitors and Cloud Media Works LLC, Service account holders (collectively, “Users”) understand how we collect, use, protect, and may share the personally identifiable information that they provide us.

2.    Collecting Information

      I.        Website Information Collection

There are generally two types of information that we collect from our Website visitors (including Cloud Media Works LLC, Service account holders who visit or use our Site or use the Cloud Media Works LLC, Service):

  1. Technical Information. Certain non-personal information is recorded about our Users by the standard operation of our Internet servers. This information is used primarily to provide an enhanced online experience for our Users. Collected information could include the type of browser being used (e.g., Chrome, FireFox, Safari, Mozilla, Internet Explorer), the types of operating systems in use (e.g., iOS, Android, Windows) and the domain names of Internet service providers being used (e.g., Google, Bing, America Online, Yahoo!). Collecting this information allows us to optimize our Website pages and the Cloud Media Works LLC, Service for a particular User’s computer or other Internet-enabled device. Other uses of the foregoing information may include internal review of the number of people who visited our Website or Use the Cloud Media Works LLC, Service but only in an aggregate and non-personally identifiable form.

  2. Volunteered Information. Email addresses and other personally identifiable information provided by Users through the use of our Website or the use of Cloud Media Works LLC, Service are known to us only when voluntarily submitted by our Users. We will use personally identifiable information provided at our Website or the Cloud Media Works LLC, Service only for the purposes described at the time it is collected or as set forth in this Privacy Policy (e.g., the email addresses Users provide in order to receive email alerts about product availability in their area will only be used for that purpose, etc.). If Users choose to correspond with us through email, we may retain their email addresses, together with the content of their messages, to respond to them and keep records of the correspondence.

    II.        Cloud Media Works LLC, Service Information Collection

Eligible individuals who wish to sign-up for a Cloud Media Works LLC, Service account will be asked to register and customize their viewing experience by accessing our secure Website or other Cloud Media Works LLC, Service and managing their account from their personal computers or other Internet-enabled devices. During the registration process, new registrants can expect to provide their basic contact information such as full name, residential address, telephone number(s), and email address. They can also voluntarily provide us with information about their viewing preferences and other interests if they want a better viewing experience. We may require financial account information from account holders to enable purchases (e.g., complete credit card numbers and expiration dates), and other information (e.g., favorite pet’s name, program preferences) to verify account information. Account holders are responsible for maintaining the integrity of their account ID and password information that are used to manage their Cloud Media Works LLC, Service preferences and programming settings (e.g., privacy controls).

We may enable standard technologies such as cookies or pixel tags and other diagnostic tools during bandwidth testing and Website and Cloud Media Works LLC, Service account signup and account management activities and to improve your User experience and the quality of the Website or the Cloud Media Works LLC, Service. The information collected through these tools may include, but is not limited to, quality measurements, error logs, software versions, date and time of use, specific streams, and content viewed. Such information may be used for improving your User experience and the quality of the Website or the Cloud Media Works LLC, Service, technical troubleshooting activities, obtaining information about how the Cloud Media Works LLC, equipment is performing, updating software/firmware, and account management or providing customer service and support. We may store technical and diagnostic information on an individually identifiable basis.

3.    Using Information

We use Users’ personally identifiable information for the purposes of delivering the Cloud Media Works LLC, Service and Website as requested, sending Users email marketing and promotions, personalizing Users’ experiences and Web pages, processing transactions, providing customer and technical support, and fulfilling other Users’ requests.

We may also use Users’ personally identifiable information to show Users advertisements on the Website or Cloud Media Works US, Inc Service. Advertisements (which may include program sponsorships and promotions) may be shown based on traditional advertising factors such as census bureau data, demographic data, and geographic data that we obtain from our Users’ or from third party sources. We may also show advertisements based on preference information that Users voluntarily or knowingly provide us when signing up for or using the Cloud Media Works LLC, Service or Website (e.g., selected advertisement categories and genre preferences, responses to polls/surveys).

In our efforts to improve the Cloud Media Works LLC, Service, we may enhance, update, or add personally identifiable or demographic information that we obtain from reputable third party sources to our existing User records. We may use this additional information for our own marketing efforts or in other ways as set forth in this Section.

4.    Sharing Information

Cloud Media Works LLC, may share the information Users provide us in the following ways:

  1. Vendors. We may use outside companies, agents, or contractors (“vendors”) to provide support for our internal operations or to assist us with administering our Website, certain portions of the Cloud Media Works LLC, Service or other Cloud Media Works LLC, programs or services (e.g., order fulfillment, credit card processing, customer support, User data enhancement, etc.). In the course of performing such services on our behalf, vendors who obtain or have access to personally identifiable information may only use that information for the specific tasks we have hired them to do and are prohibited from using Users’ personally identifiable information for any other purpose.

  2. Business Partners. From time to time, we may carefully select and partner with other companies that we believe offer products and services that could help us deliver, co-service, co-market, improve, or otherwise add value to the Cloud Media Works LLC, Service, the Website and corresponding User experience (e.g., telecommunications providers, third party merchants, etc.). To work effectively with these business partners, we may need to share with them and have them process a limited amount of personally identifiable information about our Users. When personally identifiable information may be shared with or simultaneously collected by one of our business partners, it will either be obvious to our Users from the context (such as clearly-marked branding on the page) or Users will be notified about the sharing at the time and location where the relevant personally identifiable information is collected. Business partners are required to protect the confidentiality and integrity of any personally identifiable information that we share with them.

  3. With Users’ Consent. We may share Users’ personally identifiable information when they authorize us to do so. For example, by expressing their consent to have their personally identifiable information shared for a specific purpose at the time the information is collected.

  4. Business and Legal Transfers. In the event our company merges with or is acquired by another entity, or if we were to sell or dispose of all or a part of the Cloud Media Works LLC, business or assets, the acquirer may have access to the information previously maintained by us, that could include Users’ personally identifiable information. Similarly, any information in our possession, including Users’ personally identifiable information, may be transferred to a third party entity as part of a corporate reorganization, insolvency proceeding, or other similar event. We may also be required to share Users’ personally identifiable information to comply with laws, legal claims, or law enforcement requests (e.g., subpoena, search warrant or other legal process), enforce applicable Terms of Service, including investigation of potential violations, detect, prevent, or otherwise address fraud, security or technical issues, protect against harm to the rights, property or safety of the Cloud Media Works LLC,, our Users or the public as required or permitted by law.

  5. e.     Aggregate Reporting. We may share anonymous aggregate information about the use of the Cloud Media Works LLC, Service or Website by our Users with advertisers, media companies, and content producers. This allows us to report back to them viewing statistics and revenue information generated by their advertisements and content. In some cases, we may use and share this type of information to determine what content is more popular or to see if programs and ads were watched to their conclusion. We may also occasionally share Users’ demographic information in anonymous aggregate form with third parties, including audience measurement firms who, in turn, may combine our anonymous aggregate information with other aggregated demographics data to form more complete audience analysis information. Information shared for these purposes may include information captured through the use of cookies or other similar diagnostic tools (as described in Section 2 above) but does not include any personally identifiable information.

  6.      Location Information. When you use the Website or Cloud Media Works LLC, Service, we may collect and process information about your actual location. We use various technologies to determine location, including IP address, GPS, and other sensors that may, for example, provide us or our vendors or business partners with information regarding nearby devices, Wi-Fi access points and cell towers.

  7.      Unique Application Numbers. Certain services of the Cloud Media Works LLC, Service may include a unique application number. This number and information about your installation (for example, the operating system type and application version number) may be sent to us or our vendors or business partners when you install or uninstall that service or when that service periodically contacts our servers, such as for automatic updates.

  8.      Local Storage. We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

  9.      Domain Administrators. If your usage of the Website or your Cloud Media Works LLC, account is managed for you by a domain administrator then your domain administrator and resellers who provide User support to your organization will have access to your Cloud Media Works LLC, account information (including your email and other data). Your domain administrator may be able to:

  • view statistics regarding your account, like statistics regarding content you view.

  • change your account password.

  • suspend or terminate your account access.

  • access or retain information stored as part of your account.

  • receive your account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request.

  • restrict your ability to delete or edit information or privacy settings.

5.    Updating Account Information

Cloud Media Works LLC, Service account holders may access their account through the Cloud Media Works LLC, Service and our Website at any time, whether it is to change their preferences, or passwords, update their billing or contact information, or select new features. For security reasons, we do not store full credit card information, which may result in account holders occasionally needing to update their account (such as updating credit card expiration dates). Some account management choices are available directly on the Cloud Media Works LLC, Service via remote control. Users can also contact us at privacy@Cloud Media Works.net to advise us of necessary account corrections or request the deletion of personally identifiable information we may have on file about them. We will make reasonable efforts to promptly fulfill such requests, although some personally identifiable information may be retained in our archived records.

6.    Third-Party Websites and Services

Some of the pages on our Website or within the Cloud Media Works LLC, Service may contain links (or suggested links) to other sites and to other companies, including our business partners. When Users choose to activate such links, Users will be connected to pages or content that may be on another site or operated by another entity, and therefore not subject to our policies. Any information that Users provide to that entity will be subject to that entity’s privacy policies and legal terms. We cannot make any representations about the practices and policies of third party entities, and we do not warrant their products or services.

7.    Minors

We do not knowingly collect personally identifiable information from minors (i.e., persons under the age of 18); however, we cannot always determine the age of persons who access or use our Websites or the Cloud Media Works LLC, Service. If a minor (as defined by law) provides us with his/her personally identifiable information without parental or guardian consent, we encourage the parent or guardian to contact us immediately to request the removal of such information, and, if applicable, to unsubscribe the minor from future Cloud Media Works LLC, marketing communications.

8.    Securing Information

Cloud Media Works LLC, takes a number of measures to protect the security and confidentiality of our Users’ personally identifiable information. These measures include, but are not limited to, storing our Users’ data in secure operating environments and using industry-standard encryption to protect sensitive data (such as credit card information) while it is transmitted over the Internet. We restrict access to personal information to Cloud Media Works LLC, employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.  To further reduce the risk of unauthorized access to our Users’ account information, we urge our Users to keep their passwords in a safe place and not divulge them to anyone else.

9.    Your Agreement / Privacy Policy Changes

By visiting, accessing, and/or using our Website or the Cloud Media Works LLC, Service, Users acknowledge they have read and agree to the practices and terms set forth in this Privacy Policy. Users who do not agree to this Privacy Policy must not visit, access, or use our Site or the Cloud Media Works LLC, Service.

This Privacy Policy may be re-assessed and updated from time to time to reflect evolving technology, legal requirements and our business practices. If we make any changes to this Privacy Policy, we will modify this document and update the effective date at the top of this page or post the date the most recent revisions were made. Users must check back periodically to ensure they are aware of these changes. The continued use of our Site or the Cloud Media Works LLC, Service after these changes are posted will signify a User’s acceptance of the new or revised Privacy Policy.

If we make a material change to this Privacy Policy (for example, we want to share Users’ personally identifiable information in ways not previously disclosed in this Privacy Policy or that could not be reasonably expected by our Users), we will notify our Users by posting a prominent notice about the change on our Site, within the Cloud Media Works LLC, Service or in this Privacy Policy, and, if necessary or appropriate, provide Users with certain choices before any such change takes effect.
